Privacy Policy

This policy explains what TOPSICO LLC collects, why we collect it, who sees it and how you get out. It covers this website and our text messaging program.

1. Who we are

TOPSICO LLC is a Tennessee limited liability company that buys residential real property for its own account in Memphis and the surrounding area. In this policy, "we", "us" and "our" mean TOPSICO LLC. "You" means anyone who visits this website, submits our inquiry form or exchanges messages with us.

2. What we collect

Information you give us

When you fill in our property inquiry form, reply to one of our messages or email us, we collect what you choose to send. That normally includes:

• Your name
• Your phone number
• Your email address, if you provide one
• The property address you are asking about
• How long you have owned the property and your timeline for selling
• Anything you tell us about the property's condition, occupancy or your price expectations
• Whether you gave consent to be texted, and the date and time you gave it

Information collected automatically

Our web host records standard technical data when a page loads, such as IP address, browser type, referring page and time of request. This is used to keep the site running and secure. We do not run advertising trackers or third party marketing pixels on this site.

Message records

We keep a record of text messages and emails between us, including their content and timestamps, along with your opt-in and any opt-out request.

3. Where property information comes from

If we contacted you before you ever contacted us, this section is the one you are looking for.

Property ownership, sale history, assessed values, lot details and owner mailing addresses are matters of public record in Tennessee and are published by county offices including the Shelby County Assessor and the Register of Deeds. We work from that public record data, and from commercially available real estate datasets and skip tracing services that compile and supplement it.

We did not obtain your information from a social media account, a mobile app, or a purchased consumer list built from your online activity. If you want to be removed from our outreach, see Your choices and rights below and we will take you off.

4. How we use information

We use what we collect to:

• Respond to your inquiry and answer your questions
• Research a property and work out what we are able to pay for it
• Communicate with you by text, phone or email about that property
• Prepare, negotiate and close a purchase if you decide to move forward
• Keep records of consent, opt-outs and removal requests so we honor them
• Maintain the security of our systems and meet our legal and regulatory obligations

We do not use your information to build advertising profiles, and we do not sell it.

5. Text messaging and your consent

We do not sell, rent, trade or otherwise share your SMS opt-in information or your phone number with third parties for their own marketing purposes. Consent to receive text messages from TOPSICO LLC is never shared with anyone else for marketing, and it is not part of any information we might disclose to service providers or affiliates for other reasons.

What you are agreeing to

When you check the consent box on our inquiry form, you agree to receive text messages from TOPSICO LLC at the number you gave us, about the property you asked about, including messages sent using automated technology. Consent is not a condition of buying or selling anything.

Frequency and cost

Message frequency varies and depends on the conversation. Message and data rates may apply, according to your plan with your mobile carrier. We do not charge you for messages.

Stopping messages

Reply STOP to any message and we will stop texting that number. You can also email hello@topsico.com and ask us to remove you. Reply HELP for help, or contact us at the email or address above.

Carriers

Mobile carriers are not liable for delayed or undelivered messages. Delivery is not guaranteed and depends on your carrier and your device.

6. Who we share information with

We share information only where it is needed to do the work or where the law requires it:

• Service providers. Companies that operate our website, our customer relationship system, our phone and messaging service and our email, acting on our instructions and only for the purpose of providing those services to us.
• Transaction parties. If you decide to sell to us, the people needed to close, which may include a title company, a closing attorney, an escrow agent, a surveyor, an inspector or a lender.
• Professional advisers. Our attorneys and accountants, where relevant.
• Legal and safety. Where we are required to by law, subpoena or court order, or to establish or defend legal claims.
• Business transfer. If our business or its assets are acquired or reorganized, information may transfer as part of that transaction, subject to this policy.

We do not sell your personal information, and we do not share it with third parties for their own marketing.

7. How long we keep it

We keep inquiry and correspondence records for as long as we are working with you and afterwards for as long as we need them for our records, to resolve disputes and to meet legal, tax and accounting obligations. Records relating to a completed purchase are kept longer because property transactions have long tails.

Opt-out and removal records are kept indefinitely, because that is how we make sure we do not contact you again by mistake.

8. Your choices and rights

• Stop texts. Reply STOP to any message.
• Be removed entirely. Email hello@topsico.com with the phone number or property address and ask to be removed. We will suppress it across our outreach.
• Access or correct. Ask us what we hold about you and we will tell you, and correct anything that is wrong.
• Delete. Ask us to delete what we hold. We will, other than records we are required to keep or need to keep for the reasons in section 7, including your suppression record.

Write to hello@topsico.com for any of these. We aim to respond within 30 days. Depending on where you live you may have additional statutory rights, and we will honor those where they apply to us.

9. Security

We use reasonable administrative and technical measures to protect the information we hold, including access controls and encrypted connections to this website. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. Please do not send sensitive identifiers such as a Social Security number or bank account details through the inquiry form or by text. If a transaction requires that information, it will be handled through the closing agent.

10. Children

This site and our messaging program are for adults. They are not directed at anyone under 18 and we do not knowingly collect information from anyone under 18. If you believe a minor has given us information, email us and we will delete it.

11. Changes to this policy

If we change this policy we will post the new version here and update the effective date at the top. If a change is significant and affects how we use information you already gave us, we will make a reasonable effort to tell you directly.
